Legal Advice for Homologating Foreign Divorces
A Portuguese citizen who has been divorced abroad has a legal obligation to update their marital status in Portugal.
A divorce that occurred abroad cannot be registered directly at the Portuguese Consulate; it must be homologated by the competent "Tribunal da Relação" in Portugal.
The procedure for recognizing a foreign divorce decree does not require the presence of the former spouses in Portugal; it is sufficient for the lawyer to file the action by presenting the necessary documentation and holding a power of attorney with special powers for the act.
At the end of the process, the marital status of the person will be updated to "divorced" on the birth certificate at the "Conservatória de Registo Civil."
